1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Creative Engineering website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Description

Creative Engineering ("Company," "we," "us," or "our") provides:

  • Industrial adhesives, tapes, coatings, and related products
  • Technical consultation and support services
  • Custom formulating and converting services
  • Equipment sales and rental
  • Online product catalog and ordering services

3. Product Information

3.1 Product Accuracy

We strive to provide accurate product descriptions, specifications, and pricing. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.

3.2 Product Availability

Product availability is subject to change without notice. We reserve the right to discontinue any product at any time. Prices are subject to change based on market conditions and supplier pricing.

3.3 Technical Specifications

Technical specifications provided are for reference only. Users should verify product suitability for their specific applications. Our technical team is available for consultation.

4. Orders and Payment

4.1 Order Acceptance

Orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, pricing errors, or suspected fraudulent activity.

4.2 Pricing

All prices are listed in Vietnamese Dong (VND) unless otherwise specified. Prices do not include taxes, shipping, or handling charges unless stated. We reserve the right to change prices without notice.

4.3 Payment Terms

Payment terms are as agreed between parties. For new customers, prepayment or cash on delivery may be required. Established customers may be eligible for credit terms subject to approval.

4.4 Taxes

You are responsible for all applicable taxes. Prices do not include VAT unless explicitly stated. Tax-exempt status requires valid documentation.

5. Shipping and Delivery

5.1 Shipping Terms

Shipping terms are typically DAP (Delivered at Place) or EXW (Ex Works) unless otherwise agreed. Risk of loss transfers upon delivery to the carrier.

5.2 Delivery Times

Estimated delivery times are provided for reference only. We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control.

5.3 Inspection

Upon receipt, buyers must inspect goods immediately and report any damage or discrepancies within 24 hours. Failure to report within this period may void claims.

6. Returns and Refunds

6.1 Return Policy

Standard products may be returned within 30 days of delivery if unused and in original packaging. Custom-formulated products, hazardous materials, and items past shelf life are non-returnable.

6.2 Refund Process

Refunds are processed within 15 business days of receiving returned goods. Original shipping fees are non-refundable. Credit card refunds may take additional time depending on your bank.

6.3 Defective Products

Defective products will be replaced or credited at our discretion. Proof of defect may be required. Warranty claims are subject to manufacturer terms.

7. Intellectual Property

7.1 Ownership

All content on this website, including text, graphics, logos, images, and software, is the property of Creative Engineering or its content suppliers and is protected by Vietnamese and international copyright laws.

7.2 Trademarks

All trademarks, service marks, and trade names are proprietary to Creative Engineering or their respective owners. Unauthorized use is prohibited.

7.3 Product Formulations

Technical formulations and trade secrets remain our property. Customers may not reverse engineer, analyze, or replicate our custom products.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVE ENGINEERING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

Our total liability for any claim shall not exceed the amount paid for the products or services giving rise to the claim.

9. Warranty Disclaimer

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information
  • Use products in accordance with safety guidelines
  • Comply with all applicable laws and regulations
  • Not engage in fraudulent or illegal activity

13. Force Majeure

We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, supply chain disruptions, or government actions.

These Terms shall be governed by the laws of Vietnam. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ho Chi Minh City.

15. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on this website. Your continued use constitutes acceptance of modified Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
